Terms of Use for Habit365

1. Acceptance of Terms

Welcome to Habit365! These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Habit365 (“we,” “us,” or “our”) governing your access to and use of the Habit365 mobile application (“App” or “Service”).

By downloading, installing, accessing, or using Habit365, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not download, install, or use Habit365. We reserve the right to modify these Terms at any time, and your continued use of Habit365 after such modifications constitutes your acceptance of the updated Terms.

2. Description of Service

Habit365 is a comprehensive habit tracking application designed to help users build positive routines, track daily habits, monitor progress, and achieve personal goals. The Habit365 App provides features including but not limited to:

Creating and managing custom habits
Daily habit tracking and completion logging
Streak monitoring and statistics visualization
Goal setting and achievement tracking
Challenge participation and progress monitoring
Mood tracking and personal notes
Customizable reminders and notifications
Data synchronization across devices via iCloud
Widget support for quick access
Apple Watch companion app

Habit365 is available for iOS, iPadOS, and watchOS devices through the Apple App Store.

3. Eligibility

To use Habit365, you must:

Be at least 13 years of age (or the minimum age required in your jurisdiction)
Have the legal capacity to enter into a binding agreement
Not be prohibited from using the App under applicable laws

If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. Parents and guardians are responsible for supervising their minor children’s use of Habit365.

4. Account and User Responsibilities

4.1 User Data

When using Habit365, you are responsible for:

The accuracy and completeness of any information you provide
Maintaining the confidentiality of your device and any data stored within the App
All activities that occur under your use of Habit365
Creating appropriate backups of your data

4.2 Acceptable Use

You agree to use Habit365 only for lawful purposes and in accordance with these Terms. You agree NOT to:

Use Habit365 in any way that violates applicable laws or regulations
Attempt to gain unauthorized access to any portion of the App or its systems
Interfere with or disrupt the integrity or performance of Habit365
Attempt to reverse engineer, decompile, or disassemble any portion of the App
Use Habit365 to transmit any malicious code, viruses, or harmful data
Remove, alter, or obscure any proprietary notices within the App
Use automated systems or software to extract data from Habit365
Sublicense, sell, or redistribute Habit365 or any part thereof

5. Subscription and In-App Purchases

5.1 Free and Premium Features

Habit365 offers both free and premium features. The free version of Habit365 includes basic habit tracking functionality with certain limitations. Premium features (“Habit365 Premium”) are available through a paid subscription and include:

Unlimited habit creation
Advanced statistics and analytics
Detailed reports and insights
Goals and achievements system
Challenge features
Priority support

5.2 Subscription Terms

Habit365 Premium is offered as an auto-renewable subscription. By subscribing to Habit365 Premium:

Payment will be charged to your Apple ID account at confirmation of purchase
Subscription automatically renews unless canceled at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage and cancel your subscription through your Apple ID Account Settings
Any unused portion of a free trial period will be forfeited upon purchasing a subscription

5.3 Pricing and Changes

Subscription prices are displayed in the App and may vary by region. We reserve the right to change subscription prices at any time. Price changes will not affect your current subscription period but will apply to subsequent renewals. You will be notified of any price changes in advance.

5.4 Refunds

All purchases are processed through the Apple App Store. Refund requests must be submitted directly to Apple in accordance with their refund policies. We do not have the ability to process refunds directly.

6. Intellectual Property Rights

6.1 Ownership

Habit365, including all content, features, functionality, design, graphics, logos, icons, and software, is owned by Habit365 and is protected by international copyright, trademark, and other intellectual property laws. These Terms do not grant you any ownership rights in Habit365.

6.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Habit365 on devices that you own or control, solely for your personal, non-commercial use.

6.3 User Content

You retain ownership of any personal data, habit information, notes, and other content you create within Habit365 (“User Content”). By using Habit365, you grant us a limited license to process and store your User Content solely for the purpose of providing the Service to you.

7. Disclaimer of Warranties

HABIT365 IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
WARRANTIES OF NON-INFRINGEMENT
WARRANTIES THAT HABIT365 WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH HABIT365

Habit365 is designed as a personal organization and tracking tool. It is NOT intended to provide medical, health, psychological, or professional advice. You should consult appropriate professionals for any health-related decisions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HABIT365, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Any loss of profits, data, use, goodwill, or other intangible losses
Any damages resulting from unauthorized access to or use of our servers
Any damages resulting from interruption or cessation of the Service
Any bugs, viruses, or similar issues transmitted through the App

Our total liability for any claims arising from or related to these Terms or your use of Habit365 shall not exceed the amount you paid for Habit365 Premium in the twelve (12) months preceding the claim, or fifty US dollars ($50), whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Habit365 and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use or misuse of Habit365
Your violation of these Terms
Your violation of any rights of any third party
Any User Content you create or submit through Habit365

10. Third-Party Services

Habit365 integrates with third-party services including Apple iCloud, Apple App Store, and Apple Push Notification Service. Your use of these services is governed by their respective terms and conditions. We are not responsible for the availability, accuracy, or content of any third-party services.

11. Termination

11.1 By You

You may stop using Habit365 at any time by deleting the App from your devices. You may cancel your Habit365 Premium subscription through your Apple ID Account Settings.

11.2 By Us

We reserve the right to suspend or terminate your access to Habit365 at any time, with or without cause, and with or without notice. Upon termination, your right to use Habit365 will immediately cease.

11.3 Effect of Termination

Upon termination, all licenses granted to you under these Terms will immediately terminate. Sections of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Habit365 operates, without regard to conflict of law principles. Any disputes arising from these Terms or your use of Habit365 shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Habit365 regarding your use of the App.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

BY USING HABIT365, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF USE. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE HABIT365.
